Terms & Conditions
Please read these terms before creating an account, placing an order, or buying credits.
1. Who these terms are between
These Terms & Conditions govern your use of the SJ Tronic dealer portal and every file, service and credit purchased through it. In these terms, “we”, “us” and “SJ Tronic” mean SJ Tronic; “you” and “the dealer” mean the business or individual holding the portal account.
By creating an account, buying credits, or unlocking a file you agree to these terms. If you do not agree with them, do not use the portal.
2. Professional use only
The portal is offered strictly on a business-to-business basis to professionals in the motor trade. By using it you confirm that you are a professional engaged in vehicle tuning, diagnostics, servicing or repair; that you are competent and suitably equipped to read from and write to vehicle control units; and that you are acting in the course of your business and not as a consumer.
You are responsible for judging whether any modification is appropriate, safe and lawful for the vehicle, its owner and the territory in which it is used. We supply modified data; we do not inspect vehicles, and we rely entirely on the information and files you provide.
You must not resell, sublicense or redistribute access to the portal, and you must not represent yourself as an agent, employee or authorised representative of SJ Tronic.
3. What the service is
You upload a file read from a vehicle control unit together with the vehicle details and the work you want carried out. We modify that data and return a finished file to your account.
We work only on the data you send us. We cannot verify that a file was read correctly, that it matches the vehicle described, or that the vehicle is mechanically sound. A faulty, partial or mismatched read will produce a faulty result.
Any performance figures, gains, fuel-consumption changes or other outcomes mentioned anywhere on the portal are estimates based on typical results. They are not promises, and results vary with vehicle condition, fuel quality, ambient conditions, hardware and installation.
Turnaround times shown in the portal are indicative only. We do not guarantee that the service, or any particular file, will be available or completed within a given time.
4. Your responsibilities
Before writing any file to a vehicle you must: keep an unmodified backup of the original read; verify that the file matches the exact vehicle, control unit and software version; confirm the checksum is correct for the target control unit; and satisfy yourself that the vehicle is in a fit mechanical condition for the modification.
You are responsible for the flashing process itself, including a stable power supply and a reliable tool and connection. Interrupted or incorrect writing can permanently damage a control unit, and that risk sits with you.
You are responsible for obtaining the informed consent of the vehicle owner, and for telling them how the modification may affect their manufacturer warranty, insurance, roadworthiness, emissions compliance and resale value.
You must keep your account credentials secure and not share them. Everything done through your account is treated as done by you.
5. Legality, emissions and road use
Laws on vehicle modification, emissions equipment and type approval differ by country and can be strict. It is entirely your responsibility to ensure that any work you request and install complies with the law where the vehicle is registered and used.
Certain modifications — including but not limited to the removal or defeat of emissions-control equipment — are unlawful on public roads in many jurisdictions. Where such work is supplied, it is supplied for motorsport, off-road, export or research use only, on your explicit confirmation that this is its purpose.
You indemnify us against any fine, penalty, prosecution, claim or cost arising from a modification being installed or used unlawfully.
6. Credits, pricing and payment
Work on the portal is paid for with credits. Credits are a prepaid balance for use on this portal only. They are not money, they carry no cash value, they earn no interest, and they cannot be exchanged for cash or transferred to another account.
The credit cost of a request is shown before you unlock it. You are charged only when you unlock or download the finished file — uploading a request and receiving a price costs nothing. A dealer's first request requires a minimum credit balance before it can be submitted.
Prices may change at any time. The price that applies to a request is the one shown on that request.
Credit purchases are processed by PayPal. We do not receive or store your card details. Your purchase is also subject to PayPal's own terms.
Where a payment is reversed, charged back or otherwise fails after credits have been issued, we may remove the corresponding credits and suspend the account until the matter is resolved.
7. Refunds
Refunds are issued as portal credit only. We do not refund money to PayPal, to a card, or by any other means, whether or not the original purchase was made that way.
Because a tuned file is delivered digitally and cannot be returned once downloaded, an unlocked file is not refundable as a matter of course. Where we agree that a file was not fit for the purpose described, we will first attempt to correct or re-do the work; if we cannot, we will credit the request back to your portal balance.
Unused credits are non-refundable. Credit issued as a refund or goodwill adjustment may not be withdrawn as cash.
Nothing in this section limits any right you have under law that cannot lawfully be excluded.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any loss or damage — direct, indirect, incidental, consequential, accidental or otherwise — arising from the supply or use of a file or the use of the portal. This includes, without limitation: damage to a control unit, engine, gearbox, drivetrain or any other part of a vehicle; a vehicle being immobilised; towing, recovery, diagnostic, repair or replacement costs; loss of use, loss of profit, loss of business, loss of data, or damage to reputation; and any claim brought against you by a vehicle owner or third party.
Where liability cannot lawfully be excluded, our total liability for any claim is limited to the credits paid for the specific request giving rise to the claim, refundable as portal credit in accordance with section 7.
We do not exclude liability for death or personal injury caused by our negligence, or for fraud, or for anything else that cannot lawfully be excluded.
You accept that vehicle modification carries inherent risk, that you are the professional installing the work, and that you are best placed to judge and manage that risk.
9. Intellectual property and file use
A file we supply is licensed to you for use on the single vehicle it was prepared for. You may not copy, resell, share, publish or redistribute it, use it on any other vehicle, or reverse-engineer it to produce derivative files for sale.
We retain all rights in our own tools, methods, calibrations and portal software. Nothing in these terms transfers ownership of them to you.
You confirm you have the right to send us every file you upload, and you grant us the licence needed to process it in order to provide the service.
10. Data protection and confidentiality
We process your account details and uploaded files only to provide the service, and we keep them confidential. Files and vehicle data are retained for support, re-issue and dispute-resolution purposes.
We treat personal information in line with applicable data-protection law. If you send us personal information belonging to a vehicle owner, you confirm you are entitled to share it with us for this purpose.
We may share information where we are legally required to do so.
11. Accounts, suspension and termination
Dealer accounts are approved at our discretion, and we may decline an application without giving reasons.
We may decline any individual request — for example where a read is unusable, a control unit is unsupported, or the work requested is one we are not prepared to carry out. A declined request is closed and nothing is charged for it.
We may suspend or close an account that breaches these terms, that is used fraudulently, or that has an unresolved outstanding balance. On closure, unused credits are forfeited unless we agree otherwise in writing.
12. Availability of the portal
We aim to keep the portal available, but we do not guarantee uninterrupted access. It may be unavailable for maintenance, updates, or reasons beyond our control, and we are not liable for loss arising from downtime.
13. Changes to these terms
We may update these terms from time to time. The version in force is the one published on this page, and it applies to every request and purchase made after it is published. You are asked to accept the current terms each time you unlock a file or buy credits, and we keep a record of each acceptance.
14. Governing law
These terms are governed by the laws of the Republic of South Africa, and the South African courts have exclusive jurisdiction over any dispute arising from them.
If any part of these terms is found unenforceable, the rest remains in force.
15. Contact
Questions about these terms can be raised through a support ticket in the portal, or by replying to any email you receive from us.
